MHSWR 1999 does not explicitly specify a requirement to retain training records, but maintaining records is essential to demonstrate compliance with the training duty in regulation 13. Specific regulations such as COSHH 2002 (regulation 11, health surveillance records) and LOLER 1998 (regulation 9, examination records) require specific records to be kept. HSE guidance recommends that all health and safety training is recorded.

Practitioner note: The record is the evidence. Capture content and assessed understanding, not just attendance, because a signature sheet alone proves very little.
