“willful violation”Exact equivalent

A willful violation is one committed with intentional, knowing, or voluntary disregard for the law, or with plain indifference to employee safety. Courts have found willfulness where the employer was aware of the applicable standard or of the hazardous condition and made no reasonable effort to eliminate it. Maximum penalty is significantly higher than for serious violations.

StatutoryOccupational Safety and Health Act 1970, section 17(a); case law interpretationSource

Note: A US-specific enforcement classification. GB and Irish law treat wilful disregard through prosecution rather than a distinct notice class.

Practitioner note: Intent is inferred from conduct, most often from a known hazard left uncorrected. Willful findings can expose individuals to criminal liability where a fatality follows.
